There is no chemical distinction between “Delta 9 in marijuana” and “Delta 9 in hemp.” The compound is identical. The only difference is the concentration in the source plant.

That distinction — concentration in the source plant — is the entire basis of the legal category called “hemp-derived Delta 9.” Under the 2018 Farm Bill (the Agriculture Improvement Act), any cannabis plant containing 0.3% or less delta-9 THC by dry weight is legally classified as hemp, and products derived from it are federally legal. A large hemp plant at 0.3% can yield a meaningful amount of Delta 9 — enough to make a 5 mg gummy — and that gummy, by federal law, is a hemp product.

So a hemp-derived Delta 9 gummy is real Delta 9 THC. Not a clever cousin compound. Not “the minor cannabinoid that complements CBD” — that line, which appears in a lot of marketing, is misleading. Where the Legality Breaks Down
